By downloading, installing, or using the Sommo mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

Sommo is a mobile application that helps users learn about wine through:

  • AI-powered wine label scanning
  • Educational content and quizzes
  • Personal wine journaling
  • Interactive wine region exploration
  • Gamified learning with achievements and levels

User Accounts

Account Creation

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Age Requirement

You must be at least 21 years old (or the legal drinking age in your jurisdiction) to use this App. By using Sommo, you confirm that you meet this age requirement.

Subscription Terms

Free Tier

The free tier includes:

  • 5 lifetime wine scans per device
  • Access to all learning modules
  • Unlimited wine journal entries
  • Region exploration features

Premium Subscription

Premium subscribers receive:

  • Unlimited wine scans
  • All free tier features
  • Ad-free experience

Billing

  • Subscriptions are billed monthly or annually
  • Payment is charged to your App Store account
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
  • You can manage subscriptions in your App Store account settings

Refunds

Refunds are handled according to Apple App Store policies.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer or modify the App
  • Interfere with the App’s operation or security
  • Share your account with others
  • Upload harmful or inappropriate content
  • Violate any applicable laws or regulations

Intellectual Property

All content in Sommo, including but not limited to text, graphics, logos, images, and software, is owned by Sommo or its licensors and protected by intellectual property laws.

User Content

Your Content

You retain ownership of content you create (journal entries, notes). By using the App, you grant us a license to store and display your content as necessary to provide the service.

Content Guidelines

User-generated content must not:

  • Violate any laws
  • Infringe on others’ rights
  • Contain harmful or offensive material

AI-Powered Features

Wine Scanning

Our AI-powered wine scanning uses Sommo AI. While we strive for accuracy:

  • Results are for informational purposes only
  • We do not guarantee the accuracy of AI-generated content
  • Always verify important information independently

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMMO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Indemnification

You agree to indemnify and hold harmless Sommo and its affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the App settings.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
